Terms of Service

Effective date: May 22, 2026

These Terms of Service (“Terms”) are a legal agreement between you and Vantage Test Prep (“Vantage,” “we,” “us,” or “our”) governing your access to and use of the ACT preparation platform at prepwithvantage.com(the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you are under 18 years of age, a parent or legal guardian must review these Terms and agree on your behalf before you use the Service.

1. Eligibility

You must be at least 13 years of age to create an account or use the Service. We do not knowingly permit users under 13. By creating an account, you represent and warrant that:

  • You are 13 years of age or older; and
  • If you are under 18, a parent or legal guardian has reviewed these Terms and consents to your use of the Service.

If we learn that a user is under 13, we will immediately terminate that account and delete all associated data.

2. Account Registration

You agree to:

  • Provide accurate, current, and complete information when creating your account
  • Maintain the security of your password and not share account credentials with others
  • Notify us immediately at support@prepwithvantage.com if you believe your account has been compromised
  • Accept responsibility for all activity that occurs under your account

One account per person is permitted. Creating multiple accounts to circumvent access restrictions or payment requirements is prohibited.

3. Free Tier and Paid Subscriptions

Free tier

New users receive access to a free diagnostic practice test and limited features. No payment is required for the free tier.

Paid access

Full access to the Service requires a one-time payment granting 12 months of access. By purchasing access, you agree that:

  • All fees are in U.S. dollars and are processed by Stripe
  • Payment is due in full at the time of purchase
  • Access expires at the end of your 12-month period. Renewal requires an additional purchase.
  • All sales are final and non-refundable, except where required by applicable law or at our sole discretion

Pricing changes

We reserve the right to change prices at any time. Price changes will not affect access periods already purchased.

4. Acceptable Use

You agree not to:

  • Use the Service if you are under 13 years of age
  • Share your account credentials or access with any other person
  • Copy, reproduce, modify, distribute, or create derivative works from any part of the Service or its content, including practice questions, explanations, and study plans, without our prior written consent
  • Use automated scripts, bots, or tools to access or scrape the Service
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Submit false, misleading, defamatory, or harmful content (including bug reports)
  • Attempt to gain unauthorized access to other users' accounts, our databases, or any systems connected to the Service
  • Use the Service for any unlawful purpose or in violation of any applicable law

5. Educational Content and AI

The Service uses artificial intelligence — specifically Anthropic's Claude — to generate personalized explanations for practice questions. You acknowledge that:

  • AI-generated content is provided for educational purposes and may occasionally contain errors
  • AI explanations do not substitute for instruction from a qualified ACT tutor, teacher, or official ACT preparation materials
  • We do not guarantee any specific improvement in your ACT score. Results depend on many factors, including the amount and quality of your practice, test-day conditions, and individual aptitude

6. Intellectual Property

All content, features, and functionality of the Service — including the Vantage Test Prep name and logo, original practice questions, AI-generated explanations, study plan algorithms, and software — are owned by Vantage Test Prep and protected by U.S. and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial educational purposes only. No other rights are granted.

Our practice questions and explanations are original works created by Vantage Test Prep. Reading passages are drawn from or adapted from works in the public domain. ACT® is a registered trademark of ACT, Inc. Vantage Test Prep is not affiliated with, endorsed by, or sponsored by ACT, Inc.

7. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.

8. User Content

You may submit content to us, including bug reports and descriptive text about technical issues. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content solely to operate and improve the Service. You represent that you have all rights necessary to grant this license.

9. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Supabase (data storage), Resend (email), Anthropic (AI), and Inngest (background processing). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the practices of third-party services.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Vantage Test Prep and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, or goodwill — arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising out of these Terms or your use of the Service will not exceed the greater of (a) the total amount you paid us in the twelve months preceding the claim or (b) fifty U.S. dollars ($50).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you in full.

12. Indemnification

You agree to indemnify, defend, and hold harmless Vantage Test Prep and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to (a) your violation of these Terms, (b) your use of the Service, or (c) any content you submit to the Service.

13. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms, is harmful to other users or us, or is otherwise objectionable. Upon termination, your license to use the Service ends immediately. Paid access fees are non-refundable upon termination for cause.

You may delete your account at any time by contacting us at support@prepwithvantage.com. Deletion removes your personal data as described in our Privacy Policy. Sections 6, 10, 11, 12, 14, and 15 survive termination.

14. Governing Law and Dispute Resolution

Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law provisions.

Informal resolution

Before initiating any formal legal proceeding, you agree to contact us at support@prepwithvantage.com and attempt to resolve the dispute informally. We will attempt to do the same. If we cannot resolve the dispute within 30 days of your written notice, either party may pursue formal remedies.

Venue

Any dispute not resolved informally shall be resolved exclusively in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction in those courts.

No class actions

To the extent permitted by law, you waive any right to bring or participate in any class action, collective action, or representative proceeding against Vantage Test Prep.

15. General

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Vantage Test Prep regarding the Service and supersede all prior agreements.
  • Severability: If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
  • No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign these Terms or any rights hereunder without our prior written consent. We may assign these Terms freely, including in connection with a merger or acquisition.

16. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify you by email or by posting a prominent notice within the Service at least 14 days before the revised Terms take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
